Employee Freedom of Expression: Liberty or Liability?

Recreational drug use, remains a widespread phenomenon despite ongoing efforts to penalize it. However, public policy is shifting, with some countries, like Germany, moving toward legalization, while others, like Romania, continue to impose harsher penalties.
In addition to affecting the user's overall health, drug misuse can heighten the risk of workplace accidents and negatively impact productivity. As a consequence, employers have begun to explore whether drug testing is a viable option and how it can be lawfully implemented.
In this article, experts from our Romanian member firm Suciu - Employment and Data Protection Lawyers and our German member firm ALTENBURG discuss five questions to provide more information about this issue.
